{"id":4740,"date":"2023-10-06T21:43:00","date_gmt":"2023-10-06T21:43:00","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2023\/10\/06\/nar-to-allow-listing-brokers-to-offer-0-commission\/"},"modified":"2025-03-13T02:53:09","modified_gmt":"2025-03-13T02:53:09","slug":"nar-to-allow-listing-brokers-to-offer-0-commission","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2023\/10\/06\/nar-to-allow-listing-brokers-to-offer-0-commission\/","title":{"rendered":"NAR to allow listing brokers to offer $0 commission"},"content":{"rendered":"\n<p>In a surprising twist, the <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/national-association-of-realtors\/\">National Association of Realtors<\/a><\/strong> has announced a change in how interprets its Participation Rule, which requires listing brokers to provide buyer brokers an offer of compensation in order to list on the multiple listing service (MLS).<\/p>\n\n\n\n<p>While previously NAR has stated that the offer of compensation could be as little as a penny or a dollar, in a reversal of this stance, NAR is now saying that listing brokers can offer nothing and still comply with the rule, as first reported by <strong><a href=\"https:\/\/www.inman.com\/2023\/10\/06\/in-sudden-reversal-nar-says-listing-brokers-can-offer-0\/?utm_source=dailyheadlines&amp;utm_medium=email&amp;utm_campaign=localnewsletter&amp;utm_content=997378_dek_1_20231006&amp;message_id=32940581.92238\" target=\"_blank\" rel=\"noreferrer noopener\">Inman News<\/a><\/strong>.<\/p>\n\n\n\n<p>This change comes as the trade group prepares for the three-week trial of the Sitzer\/Burnett class action buyer broker compensation lawsuit, which starts on Oct. 16.<\/p>\n\n\n\n<div class=\"wp-block-housingwire-piano-member\"><div id=\"membership-content\">\n<p>Initially filed in April 2019, the lawsuit takes aim at&nbsp;<a href=\"https:\/\/www.nar.realtor\/about-nar\/policies\/qualification-for-mls-participation-and-idx\" target=\"_blank\" rel=\"noreferrer noopener\">NAR\u2019s Participation Rule<\/a>. According to the plaintiffs, commission sharing inflates the costs for consumers, in violation of the&nbsp;<a href=\"https:\/\/www.archives.gov\/milestone-documents\/sherman-anti-trust-act\" target=\"_blank\" rel=\"noreferrer noopener\">Sherman Antitrust Act<\/a>. NAR contends that the current commission structure, which has&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/articles\/are-u-s-real-estate-commissions-illegal\/\" target=\"_blank\" rel=\"noreferrer noopener\">been in place for over 100 years<\/a>, actually helps consumers.<\/p>\n\n\n\n<p>A second larger class action suit in Illinois, known as the Moehrl suit, makes the same allegations.<\/p>\n\n\n\n<p>In addition to NAR, defendants in the lawsuit include <a href=\"https:\/\/preprod.housingwire.com\/tag\/homeservices-of-america\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>HomeServices of America<\/strong><\/a> and <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/keller-williams\/\" target=\"_blank\" rel=\"noreferrer noopener\">Keller Williams<\/a><\/strong>. Both <strong>Re\/MAX<\/strong> and <strong>Anywhere Real Estate<\/strong> were also named as defendants in both the Sitzer\/Burnett and Moehrl suits, but have both filed settlement agreements.<\/p>\n\n\n\n<p>According to an emailed statement from Michael Ketchemark, the lead trial counsel for the plaintiffs in the Sitzer\/Burnett case, NAR has repeatedly stated that a compensation offer of $0 does not comply with NAR\u2019s policies.<\/p>\n\n\n\n<p>\u201cNAR\u2019s former general counsel Cliff Niersbach testified under oath that a seller\u2019s agent cannot list a property on an MLS with an offer of zero. NAR has aggressively enforced this rule across the country. All this evidence will come out at trial. If there is now a sudden change in this long-standing policy it\u2019s a stunning admission of guilt.\u201d<\/p>\n\n\n\n<p>Ketchmark argues that this change in policy will only further the <strong>Department of Justice\u2019s <\/strong><a href=\"https:\/\/preprod.housingwire.com\/articles\/doj-tells-appeals-court-to-overturn-nar-commission-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">argument<\/a> that the MLS is used by large corporate brokers to steer buyers away from properties with low commission offers.<\/p>\n\n\n\n<p>Notably the DOJ recently filed a <a href=\"https:\/\/preprod.housingwire.com\/articles\/the-doj-intervenes-in-nosalek-buyer-broker-commission-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement of interest<\/a> in the Nosalek suit, a third antitrust class action lawsuit dealing with buyer broker compensation. <a href=\"https:\/\/preprod.housingwire.com\/articles\/doj-gets-its-way-in-buyer-broker-compensation-suit\/\" target=\"_blank\" rel=\"noreferrer noopener\">On Wednesday<\/a> a U.S. District Court judge in Boston granted the DOJ\u2019s request to extend the final approval hearing for the settlement agreement filed by defendant MLS Property Information Network.<\/p>\n\n\n\n<p>NAR is not a defendant in the lawsuit, however Anywhere, Keller Williams, RE\/MAX and HomeServices of America are. Additionally, unlike the other two buyer-broker compensation suits, <a href=\"https:\/\/preprod.housingwire.com\/articles\/anywhere-real-estate-settles-buyer-broker-commission-lawsuits\/\" target=\"_blank\" rel=\"noreferrer noopener\">Anywhere<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/articles\/re-max-settles-buyer-broker-commission-lawsuits-for-55-million\/\" target=\"_blank\" rel=\"noreferrer noopener\">RE\/MAX<\/a>&nbsp;have filed settlement agreements&nbsp;in the&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/articles\/industry-reacts-to-the-anywhere-settlement\/\" target=\"_blank\" rel=\"noreferrer noopener\">Moehrl and Sitzer\/Burnett suits<\/a>, they have not tried to settle the Nosalek suit.<\/p>\n\n\n\n<p>The change in how NAR interprets its Participation Rule comes as the terms of <a href=\"https:\/\/preprod.housingwire.com\/articles\/proposed-anywhere-settlement-no-nar-buyer-commission-rule-no-nar-membership-needed\/?utm_source=breaking_news&amp;utm_medium=Internal&amp;utm_campaign=traffic\" target=\"_blank\" rel=\"noreferrer noopener\">Anywhere\u2019s settlement<\/a> in the Sitzer\/Burnett and Moehrl lawsuits have finally been made public. Along with a $83.5 million payout, Anywhere has agreed to not require company owned brokerages, franchisees, or affiliated agents to belong to the&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/tag\/national-association-of-realtors\/\" target=\"_blank\" rel=\"noreferrer noopener\">NAR<\/a>&nbsp;or follow the NAR Code of Ethics or MLS Handbook. The firm said it will also eliminate any minimum client&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/articles\/q4-brokerpulse-commission-lawsuits-spur-proactive-changes-for-real-estate-brokers\/\" target=\"_blank\" rel=\"noreferrer noopener\">commission requirements&nbsp;<\/a>that company owned brokerages may have.<\/p>\n\n\n\n<p>Additionally, Anywhere has agreed to \u201cadvise and remind company owned brokerages, franchisees, and affiliated agents that the company has no rule&nbsp;requiring&nbsp;offers of compensation.\u201d<\/p>\n\n\n\n<p>On Monday, <strong><a href=\"https:\/\/preprod.housingwire.com\/articles\/redfin-breaks-with-nar-in-wake-of-sexual-harassment-allegations\/\" target=\"_blank\" rel=\"noreferrer noopener\">Redfin announced<\/a><\/strong> it would require agents in areas where it was possible, to cancel their NAR membership, citing the recent allegations of <a href=\"https:\/\/preprod.housingwire.com\/articles\/nar-staffers-demand-resignation-of-bob-goldberg-other-leaders\/\" target=\"_blank\" rel=\"noreferrer noopener\">sexual harassment<\/a> at NAR, as well as the trade group\u2019s buyer broker compensation policies.<\/p>\n\n\n\n<p>In August, <strong>Bright MLS<\/strong>, the nation\u2019s second largest MLS, began allowing listing agents to put in a blanket offer of&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/are-you-prepping-for-possible-commission-lawsuit-outcomes\/?__hstc=44321979.833b438a07aee8d54350f472d8a0cfd1.1672670170389.1696536156358.1696598899184.546&amp;__hssc=44321979.11.1696598899184&amp;__hsfp=2193239052\" target=\"_blank\" rel=\"noreferrer noopener\">compensation for buyer brokers<\/a>&nbsp;of zero dollars or more.<\/p>\n\n\n\n<p>At the time the <a href=\"https:\/\/preprod.housingwire.com\/articles\/bright-mls-to-allow-0-buyer-broker-commissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">company stated<\/a>: \u201cWe are making this small change to underscore the complete flexibility of Bright subscribers to engage in transparent negotiations with their clients.
