The two-page filing offered no explanation for the decision.<\/p>\n\n\n\n<p>On Thursday, the defendants in the suit, which now consist of only the <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/national-association-of-realtors\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Association of Realtors<\/a><\/strong>, <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/keller-williams\/\" target=\"_blank\" rel=\"noreferrer noopener\">Keller Williams<\/a> <\/strong>and <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/homeservices-of-america\/\" target=\"_blank\" rel=\"noreferrer noopener\">HomeServices of America<\/a><\/strong> after both <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/realogy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Anywhere<\/a><\/strong> and <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/re-max\/\" target=\"_blank\" rel=\"noreferrer noopener\">RE\/MAX<\/a><\/strong> filed <a href=\"https:\/\/preprod.housingwire.com\/articles\/re-max-settles-buyer-broker-commission-lawsuits-for-55-million\/\" target=\"_blank\" rel=\"noreferrer noopener\">settlement agreements<\/a>, filed a motion objecting to the purported withdrawal of the named plaintiffs of the eve of the trial.<\/p>\n\n\n\n<p>The defendants claim that the plaintiffs are looking to dodge cross examination.<\/p>\n\n\n\n<p>\u201cThe sudden decision on the eve of trial to withdraw three class representatives raises questions about whether the withdrawal was designed to avoid testimony that could conflict with other class representatives, raising questions about the merits and\/or the propriety of the class,\u201d the defense motion states.<\/p>\n\n\n\n<p>Initially filed in April 2019, the lawsuit takes aim at&nbsp;<a href=\"https:\/\/www.nar.realtor\/about-nar\/policies\/qualification-for-mls-participation-and-idx\" target=\"_blank\" rel=\"noreferrer noopener\">NAR\u2019s Participation Rule<\/a>, which requires listing agents to make a blanket offer of compensation to buyers\u2019 agents in order to list the property on a Realtor-affiliated&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/tag\/mls\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple listing service<\/a>&nbsp;(MLS). According to the plaintiffs, commission sharing inflates the costs for consumers, in violation of the&nbsp;<a href=\"https:\/\/www.archives.gov\/milestone-documents\/sherman-anti-trust-act\" target=\"_blank\" rel=\"noreferrer noopener\">Sherman Antitrust Act<\/a>. NAR contends that the current commission structure, which has&nbsp;<a href=\"https:\/\/preprod.housingwire.com\/articles\/are-u-s-real-estate-commissions-illegal\/\" target=\"_blank\" rel=\"noreferrer noopener\">been in place for over 100 years<\/a>, actually helps consumers.<\/p>\n\n\n\n<p>Damages in the Sitzer\/Burnett suit are anticipated to be up to $4 billion. The trial is scheduled to start on <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/homeservices-appeal-rejected-as-october-commission-trial-looms\/?__hstc=44321979.833b438a07aee8d54350f472d8a0cfd1.1672670170389.1695925392708.1695996210459.518&amp;__hssc=44321979.3.1695996210459&amp;__hsfp=1014341945\" target=\"_blank\" rel=\"noreferrer noopener\">Oct. 16<\/a>.
