{"id":4672,"date":"2023-09-06T18:12:49","date_gmt":"2023-09-06T18:12:49","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2023\/09\/06\/anywhere-real-estate-settles-buyer-broker-commission-lawsuits\/"},"modified":"2025-03-13T02:52:50","modified_gmt":"2025-03-13T02:52:50","slug":"anywhere-real-estate-settles-buyer-broker-commission-lawsuits","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2023\/09\/06\/anywhere-real-estate-settles-buyer-broker-commission-lawsuits\/","title":{"rendered":"Anywhere Real Estate settles buyer broker commission lawsuits"},"content":{"rendered":"\n<p>Real estate giant <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/realogy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Anywhere<\/a> <\/strong>has reached a settlement agreement in two of the major class action antitrust lawsuits facing the housing industry.<\/p>\n\n\n\n<p>According to court documents filed on Tuesday, Anywhere Real Estate and the home sellers suing the firm in both the <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/antitrust-agent-commission-case-appears-to-be-headed-to-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">Moehrl<\/a> and <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/homeservices-appeal-rejected-as-october-commission-trial-looms\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sitzer\/Burnett<\/a> cases, which both deal with buyer brokers\u2019 commissions, have reached a preliminary settlement agreement, settling all claims in both suits. Before the agreements are finalized they must be approved by the U.S. District Court judges in Illinois (Moehrl) and Missouri (Sitzer\/Burnett), who are overseeing the two lawsuits.<\/p>\n\n\n\n<div class=\"wp-block-housingwire-piano-member\"><div id=\"membership-content\">\n<p>No details about either agreement were disclosed in the filings, but attorneys for the plaintiffs in the Moehrl lawsuit told HousingWire the agreement for both lawsuits was a total of $83.5 million, as the two plaintiff classes negotiated the settlement together.<\/p>\n\n\n\n<p>&#8220;The monetary settlement was the most that could be obtained in light of Anywhere\u2019s available financial resources. Critically, the settlement includes significant changes to Anywhere\u2019s practices relating to the conduct that we have challenged,&#8221; Steve Berman, the managing partner and co-founder of <strong>Hagens Berman Sobol Shapirio LLP<\/strong>, wrote in an email. &#8220;Our antitrust team looks forward to continuing to pursue additional relief against remaining defendants for those who have been systematically overcharged for simply selling their homes in an already unstable housing market.\u201d<\/p>\n\n\n\n<p>Anywhere asked the court the firm be excused from the pretrial conference on the Sitzer\/Burnett suit, scheduled for this coming Friday. The Sitzer\/Burnett suit is slated to head to trial on October 16, 2023.<\/p>\n\n\n\n<p>A trial date has yet to be set for the Moehrl lawsuit.<\/p>\n\n\n\n<p>\u201cWe are pleased that Anywhere has reached a nationwide settlement with the plaintiffs in the Burnett and Moerhl lawsuits,\u201d an Anywhere spokesperson wrote in an email. \u201cThe path to obtain final approval and implement the settlement is a long one, and Anywhere has taken the first important step toward a resolution that not only releases the company but also our affiliated agents and franchisees. We believe the settlement will remove future uncertainty with respect to the upcoming trial, potential additional claims, and legal expense, enabling Anywhere to focus on and continue delivering what\u2019s next for agents and franchisees. Given ongoing legal proceedings and confidentiality agreements between parties, we cannot comment further at this time.\u201d&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Anywhere is just one of the many defendants in these lawsuits, which also include&nbsp;<strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/keller-williams\/\" target=\"_blank\" rel=\"noreferrer noopener\">Keller Williams<\/a><\/strong>, <a href=\"https:\/\/preprod.housingwire.com\/tag\/re-max\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>RE\/MAX<\/strong>,<\/a> <a href=\"https:\/\/preprod.housingwire.com\/tag\/homeservices-of-america\/\"><\/a><a href=\"https:\/\/preprod.housingwire.com\/tag\/homeservices-of-america\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>HomeServices of America<\/strong><\/a> and the <a href=\"https:\/\/preprod.housingwire.com\/tag\/national-association-of-realtors\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>National Association of Realtors<\/strong><\/a>.<\/p>\n\n\n\n<p>The two lawsuits take aim at <a href=\"https:\/\/www.nar.realtor\/about-nar\/policies\/qualification-for-mls-participation-and-idx\" target=\"_blank\" rel=\"noreferrer noopener\">NAR\u2019s Participation Rule<\/a>, which requires listing agents to make a blanket offer of compensation to buyers\u2019 agents in order to list the property on a realtor-affiliated <a href=\"https:\/\/preprod.housingwire.com\/tag\/mls\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple listing service<\/a> (MLS). According to the plaintiffs, commission sharing inflates the costs for consumers, in violation of the <a href=\"https:\/\/www.archives.gov\/milestone-documents\/sherman-anti-trust-act\" target=\"_blank\" rel=\"noreferrer noopener\">Sherman Antitrust Act<\/a>.
