{"id":4406,"date":"2023-06-05T16:56:29","date_gmt":"2023-06-05T16:56:29","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2023\/06\/05\/kw-re-max-and-others-named-in-new-jersey-housing-discrimination-suit\/"},"modified":"2025-03-13T02:51:30","modified_gmt":"2025-03-13T02:51:30","slug":"kw-re-max-and-others-named-in-new-jersey-housing-discrimination-suit","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2023\/06\/05\/kw-re-max-and-others-named-in-new-jersey-housing-discrimination-suit\/","title":{"rendered":"KW, RE\/MAX and others named in New Jersey housing discrimination suit"},"content":{"rendered":"\n<p>Some of the nation\u2019s largest real estate brands are facing even more <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/antitrust-agent-commission-case-appears-to-be-headed-to-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal woes<\/a>. <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/keller-williams\/?__hstc=43385018.5f1ddc53e010c2865f96cc27f29fdd65.1672670841746.1685981436190.1685983699440.341&amp;__hssc=43385018.4.1685983699440&amp;__hsfp=4188686977\" target=\"_blank\" rel=\"noreferrer noopener\">Keller Williams<\/a><\/strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/coldwell-banker\/\" target=\"_blank\" rel=\"noreferrer noopener\">, <strong>Coldwell Banker<\/strong><\/a>, <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/century-21\/\" target=\"_blank\" rel=\"noreferrer noopener\">Century 21<\/a><\/strong>, <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/re-max\/?__hstc=43385018.5f1ddc53e010c2865f96cc27f29fdd65.1672670841746.1685981436190.1685983699440.341&amp;__hssc=43385018.4.1685983699440&amp;__hsfp=4188686977\" target=\"_blank\" rel=\"noreferrer noopener\">RE\/MAX<\/a><\/strong> and <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/exp-realty\/\" target=\"_blank\" rel=\"noreferrer noopener\">eXp Realty<\/a><\/strong> are among 26 different landlords and real estate companies named in a <a href=\"https:\/\/preprod.housingwire.com\/tag\/discrimination\/\" target=\"_blank\" rel=\"noreferrer noopener\">housing discrimination<\/a> lawsuit filed last Wednesday by nonprofit watchdog group <strong>Housing Rights Initiative <\/strong>(HRI) in New Jersey Superior Court.<\/p>\n\n\n\n<p>The story was first reported by the <a href=\"https:\/\/newjerseymonitor.com\/2023\/05\/31\/watchdog-sues-newark-jersey-city-landlords-over-housing-discrimination-claims\/\" target=\"_blank\" rel=\"noreferrer noopener\">New Jersey Monitor<\/a>.<\/p>\n\n\n\n<p>The lawsuit claims that a group of landlords and real estate brokers refused to rent units to prospective tenants who use government-provided Section 8 housing vouchers, resulting in \u201csocioeconomic segregation in New Jersey.\u201d<\/p>\n\n\n\n<p>The \u201cdefendants\u2019 discriminatory policies result in a substantial decrease in the inventory of safe and affordable housing available to low-income tenants,\u201d the <a href=\"https:\/\/newjerseymonitor.com\/wp-content\/uploads\/2023\/05\/NJ-HRI-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a> reads.<\/p>\n\n\n\n<p>According to the lawsuit, HRI began receiving reports of housing discrimination in New Jersey in 2017. The organization subsequently began \u201ccivil rights testing\u201d by calling housing providers to see if they were obeying fair housing laws, according to the complaint. Through the testing, HRI said it found that many were not obeying these laws.<\/p>\n\n\n\n<p>The complaint details multiple instances in which an HRI representative called about rentals in Newark and Jersey City but was told that the owners did not accept Section 8 housing vouchers. These calls allegedly occurred between 2021 and 2023.<\/p>\n\n\n\n<p>\u201cIn many instances, their investigation revealed a policy or practice of effectively refusing to accept vouchers, which prompted HRI to take steps to address such violations of the law,\u201d the complaint states.<\/p>\n\n\n\n<p>Requests for comment sent to the defendants had not been returned by the time of publication.<\/p>\n\n\n\n<p>The HRI is no stranger to\u00a0<a href=\"https:\/\/www.inman.com\/2021\/06\/30\/keller-williams-exit-realty-and-dozens-of-others-sued-for-discrimination\/\" target=\"_blank\" rel=\"noreferrer noopener\">housing rights lawsuits<\/a>, including quite a few over the past few years that allege landlords are discriminating against tenants\u00a0<a href=\"https:\/\/www.nytimes.com\/2021\/03\/15\/nyregion\/real-estate-lawsuit-section-8-discrimination.html\" target=\"_blank\" rel=\"noreferrer noopener\">using federal housing assistance programs<\/a>\u00a0or refusing to follow\u00a0<a href=\"https:\/\/therealdeal.com\/2019\/09\/12\/steve-croman-hit-with-another-lawsuit-over-illegally-deregulating-apartments\/\" target=\"_blank\" rel=\"noreferrer noopener\">rent stabilized leases<\/a>. \u00a0<\/p>\n\n\n\n<p>In <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/housing-rights-initiative-sues-120-firms-in-fair-housing-suit\/\">May 2022<\/a>, HRI filed a lawsuit in New Your County Court, suing more than 120 companies, including&nbsp;<strong>Douglas Elliman<\/strong>,&nbsp;eXp Realty,&nbsp;Coldwell Banker,&nbsp;RE\/MAX&nbsp;and various other brokerage networks, as well as property owners and managers, for their \u201cpattern and practice of unlawfully discriminating against persons in the rental of lease of housing accommodations based on lawful sources of income.\u201d<\/p>\n\n\n\n<p>Discriminatory practices have for decades caused issues for the real estate industry. However, a 2019 investigation uncovered widespread discriminatory practices among agents on Long Island and propelled the issue to the forefront. This <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/ny-ag-fines-three-long-island-brokerages-for-racial-discrimination\/\" target=\"_blank\" rel=\"noreferrer noopener\">investigation resulted<\/a> in three Long Island brokerages paying $115,000 in a settlement with New York State last September.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Housing Rights Initiative
