{"id":4268,"date":"2023-05-01T16:30:52","date_gmt":"2023-05-01T16:30:52","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2023\/05\/01\/rex-to-depose-zillows-rich-barton-in-ongoing-antitrust-suit\/"},"modified":"2025-03-13T02:50:50","modified_gmt":"2025-03-13T02:50:50","slug":"rex-to-depose-zillows-rich-barton-in-ongoing-antitrust-suit","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2023\/05\/01\/rex-to-depose-zillows-rich-barton-in-ongoing-antitrust-suit\/","title":{"rendered":"REX to depose Zillow&#8217;s Rich Barton in ongoing antitrust suit"},"content":{"rendered":"\n<p>In its ongoing antitrust lawsuit against the <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/national-association-of-realtors\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Association of Realtors<\/a> <\/strong>(NAR), <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/trulia\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trulia<\/a><\/strong> and <strong>Zillow<\/strong>, <strong><a href=\"https:\/\/preprod.housingwire.com\/tag\/rex\/\" target=\"_blank\" rel=\"noreferrer noopener\">REX Real Estate<\/a><\/strong> recorded a win last Tuesday when U.S. District Court Judge Thomas Zilly approved REX\u2019s request to question Zillow CEO <a href=\"https:\/\/preprod.housingwire.com\/tag\/rich-barton\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rich Barton<\/a>.<\/p>\n\n\n\n<p><a href=\"https:\/\/preprod.housingwire.com\/tag\/zillow\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zillow<\/a> filed a motion for a protective order for Barton on April 21. In the filing, Zillow argued that REX\u2019s request should be denied as Barton doesn\u2019t have \u201cunique, non-repetitive, firsthand knowledge relevant\u201d to Project Bookshelf, the codename for Zillow\u2019s internet data exchange (IDX) and <a href=\"https:\/\/preprod.housingwire.com\/tag\/mls\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple listing service<\/a> policies.<\/p>\n\n\n\n<p>\u201cThe apex doctrine is designed to protect against precisely the tactics that Plaintiff REX \u2014 Real Estate Exchange Inc. is attempting to engage in here \u2014 abusing the discovery process to attempt to reach an apex official that has no unique, non-duplicative, firsthand knowledge of the facts at issue in this case without first exhausting any and all less intrusive means of getting the information it purports to seek,\u201d the motion reads.<\/p>\n\n\n\n<p>In addition, attorneys for Zillow noted that REX already has two other depositions with high-level Zillow executives who have more in-depth knowledge of Project Bookshelf scheduled.<\/p>\n\n\n\n<p>\u201cAs Zillow has explained repeatedly, in interrogatory responses and multiple meet-and-confers, Mr. Barton has no unique, non-duplicative personal knowledge about Project Bookshelf,\u201d the motion stated. \u201cThe Project began before Mr. Barton was CEO, and Plaintiff already is scheduled, within the next two weeks, to depose two other high-level Zillow employees who were directly involved in that Project.\u201d<\/p>\n\n\n\n<p>According to Zilly\u2019s ruling, Barton is required to attend a three-hour deposition within the next 30 days and it must take place over Zoom. In addition, Zillow, NAR, Trulia and REX have until May 16 to \u201cmeet and confer regarding possible amendments to the current motion deadlines and briefing schedule and submit a proposal to the court within the next week.\u201d<\/p>\n\n\n\n<p>Zilly also requested that REX notify the court of what party or parties are funding the litigation by May 2. REX <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/rex-closes-brokerage-hires-david-boies-in-zillow-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">ceased its brokerage operations<\/a> in mid-May of 2022. <\/p>\n\n\n\n<p>Zillow did not wish to comment on this development in the case and REX had not returned a request for comment at the time of publication.<\/p>\n\n\n\n<p>REX filed the&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/rex-real-estate-files-lawsuit-against-zillow-nar\/\" target=\"_blank\" rel=\"noreferrer noopener\">antitrust lawsuit<\/a>&nbsp;in March 2021, alleging that changes made to Zillow\u2019s website \u201cunfairly hides certain listings, shrinking their exposure and diminishing competition among real estate brokers.\u201d<\/p>\n\n\n\n<p>In&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/rex-real-estate-files-lawsuit-against-zillow-nar\/\">January 2021<\/a>, Zillow began moving homes out of its initial search results for sellers who chose not to use agents adhering to the NAR and local multiple listing service (MLS) practices.<\/p>\n\n\n\n<p>In a press release at the time, REX said it was looking to break \u201cthe stranglehold that REX believes the NAR and its members have held over consumers for generations, resulting in fees that are two to three times higher than in most developed countries. REX filed the lawsuit after the company\u2019s clients complained about the second-class treatment that non-cartel homes were receiving.\u201d<\/p>\n\n\n\n<p>In January 2022, NAR filed a&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/the-legal-battle-between-rex-homes-and-nar-heats-up%ef%bf%bc\/\" target=\"_blank\" rel=\"noreferrer noopener\">countersuit<\/a>&nbsp;claiming that REX uses false advertising and misleading claims to deceive consumers in violation of the Lanham Act, but the&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/court-dismisses-nars-countersuit-against-rex\/\" target=\"_blank\" rel=\"noreferrer noopener\">countersuit was dismissed<\/a>&nbsp;in late April 2022.<\/p>\n\n\n\n<p>Since then, REX, Zillow and NAR have gone back and forth with filing various&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/judge-orders-nar-execs-to-turn-over-documents-in-rex-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">motions to compel<\/a>&nbsp;during the discovery phase of the trial, but it appears that will all come to a head this fall.<\/p>\n\n\n\n<p>A <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/trial-date-has-been-set-in-the-rex-and-nar-antitrust-suit\/\" target=\"_blank\" rel=\"noreferrer noopener\">jury trial<\/a> for the case is scheduled for September 18, 2023.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A U.S. District Court judge in Seattle delivered a blow to Zillow by granting REX&#8217;s request to depose Zillow CEO Rich Barton in antitrust suit<\/p>\n","protected":false},"author":34740,"featured_media":4822,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3255],"tags":[],"coauthors":[1760],"class_list":["post-4268","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-archive"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v26.8) -
