{"id":4200,"date":"2023-04-11T15:54:11","date_gmt":"2023-04-11T15:54:11","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2023\/04\/11\/right-to-list-agreements-banned-by-five-more-states\/"},"modified":"2025-03-13T02:50:28","modified_gmt":"2025-03-13T02:50:28","slug":"right-to-list-agreements-banned-by-five-more-states","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2023\/04\/11\/right-to-list-agreements-banned-by-five-more-states\/","title":{"rendered":"Right to list agreements banned by five more states"},"content":{"rendered":"\n<p><a href=\"https:\/\/www.alta.org\/news\/news.cfm?20230406-5-More-States-Pass-Legislation-Banning-Unfair-Real-Estate-Fee-Agreements\" target=\"_blank\" rel=\"noreferrer noopener\">More states<\/a> are taking action against real estate firms that employ <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/real-estate-right-to-list-agreements-and-rumpelstiltskin\/\" target=\"_blank\" rel=\"noreferrer noopener\">right to list agreements<\/a> as part of their business model. Five states: Colorado, Georgia, Tennessee, Idaho and North Dakota, have now joined <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/utah-becomes-first-state-to-ban-right-to-list-agreements\/\" target=\"_blank\" rel=\"noreferrer noopener\">Utah<\/a> in banning right to list agreements like the ones used by&nbsp;<strong>MV Realty<\/strong>,&nbsp;<strong>SellWhenever<\/strong>&nbsp;and&nbsp;<strong>HomeOptions<\/strong>.<\/p>\n\n\n\n<p>According to the&nbsp;<strong>American Land Title Association<\/strong>&nbsp;(ALTA), the laws follow a model bill the trade group helped draft with the input of national stakeholders.<\/p>\n\n\n\n<p>\u201cThe property rights of American homebuyers must be protected,\u201d Elizabeth Blosser, ALTA\u2019s vice president of government affairs, said in a statement. \u201cA home often is a consumer\u2019s largest investment, and the best way to support the certainty of landownership is through public policy. We have to ensure that there are no unreasonable restraints on a homebuyer\u2019s future ability to sell or refinance their property due to unwarranted transactional costs.\u201d&nbsp;<\/p>\n\n\n\n<p>In a press release, <a href=\"https:\/\/preprod.housingwire.com\/tag\/american-land-title-association\/?__hstc=43385018.974da4d50784107c68312c9f6845d732.1681143772160.1681143772160.1681223698404.2&amp;__hssc=43385018.8.1681223698404&amp;__hsfp=1213071676\" target=\"_blank\" rel=\"noreferrer noopener\">ALTA<\/a> said the laws are designed to help \u201cprotect homeowners from predatory practice of filing of unfair real estate fee agreements in property record.\u201d<\/p>\n\n\n\n<p>These laws make right to list agreements unenforceable by law. They also restrict and prohibit the recording of right to list agreements in property records and provide for the removal of right to list agreements from property records while allowing for recovery of damages.<\/p>\n\n\n\n<p>Under the Tennessee law in particular, which is highlighted as the most restrictive, violators will also be fined $10,000 per violation.<\/p>\n\n\n\n<p>\u201cPrior to passage of the bill, over 800 of these agreements had been filed across Tennessee and being treated as liens when there was no authority for the filing of these documents,\u201d &nbsp;Joseph Kirkland Jr., a <strong>Tennessee Land Title Association<\/strong> (TNLTA) past president and current co-chair of the TNLTA Legislative Committee, said in a statement. \u201cThis is a tremendous victory for the title insurance industry and consumers of Tennessee.\u201d&nbsp;<\/p>\n\n\n\n<p>After Utah passed a bill banning right to list agreements in early March, Ken Trepeta, the executive director of the&nbsp;<strong>Real Estate Services Providers Council<\/strong>, predicted a wave of similar legislation would follow.<\/p>\n\n\n\n<p>\u201cIt is not clear whether right to list agreements run afoul of any current laws or rule so it is not surprising a legislature is not leaving the matter to chance and taking action to address the long term consumer protection concerns raised by these agreements,\u201d Trepeta wrote in an email in early March. \u201cI wouldn\u2019t be surprised if other states followed suit.\u201d<\/p>\n\n\n\n<p>Similar bills have also been introduced in California, Florida and Washington.<\/p>\n\n\n\n<p>\u201cMV supports the adoption of legislation that provides comprehensive oversight and licensure of participants in the marketplace,&#8221; an MV Realty spokesperson wrote in an email. &#8220;Any legislation should clearly spell out prohibited practices and outline specific terms that are transparent and easy to read in the language of the individual involved in the agreement.&nbsp;<\/p>\n\n\n\n<p>\u201cThe bills the American Land Title Association are advocating for rob homeowners of a valuable asset &#8211; the right to be compensated for providing a licensed realtor the listing of their home. Put simply \u2013 this bill will take money out of homeowners pockets and protect giant title insurance companies from their own negligence,&#8221; the spokesperson&#8217;s email continued.&nbsp;&#8220;Instead we hope to work with lawmakers to adopt legislation that would allow for the effective oversight and prevention of abuses and consumer protection, while allowing homeowners the option to be compensated for providing a licensed realtor the listing of their home.\u201d<\/p>\n\n\n\n<p>MV Realty, which faces&nbsp;<a href=\"https:\/\/www.mass.gov\/news\/ag-healey-sues-florida-company-for-scamming-financially-struggling-residents-into-mortgaging-their-homes-in-exchange-for-small-cash-payments\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a>&nbsp;from <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/mv-realty-is-now-under-fire-in-north-carolina\/\" target=\"_blank\" rel=\"noreferrer noopener\">five states<\/a> attorneys general alleging that it misleads and confuses homeowners through its&nbsp;<a href=\"http:\/\/homeownerbenefit.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Homeowner Benefit Program<\/a>, announced in late February that it was&nbsp;<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/mv-realty-pauses-right-to-list-agreement-program\/\" target=\"_blank\" rel=\"noreferrer noopener\">pausing the signing<\/a> of new Homeowner Benefit Agreements<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/mv-realty-pauses-right-to-list-agreement-program\/\" target=\"_blank\" rel=\"noreferrer noopener\">.<\/a> <\/p>\n\n\n\n<p>In early March, a judge granted the <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/court-orders-mv-realty-to-stop-recording-new-mortgages-in-massachusetts\/\" target=\"_blank\" rel=\"noreferrer noopener\">Massachusetts<\/a> attorney general\u2019s preliminary injunction, restricting MV Realty from engaging in unfair and deceptive marketing practices, prohibiting the company from obtaining or recording additional mortgages during the pendency of the litigation, and requiring the company to release existing mortgages.<\/p>\n\n\n\n<p><em>This article was updated with comments from MV Realty.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Colorado, Georgia, Tennessee, Idaho and North Dakota join Utah in banning firms like MV Realty from using right to list agreements.<\/p>\n","protected":false},"author":34740,"featured_media":4822,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3255],"tags":[],"coauthors":[1760],"class_list":["post-4200","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-archive"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v26.8) -
