{"id":3806,"date":"2022-12-19T22:12:09","date_gmt":"2022-12-19T22:12:09","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/12\/19\/two-more-states-sue-mv-realty\/"},"modified":"2025-03-13T02:48:29","modified_gmt":"2025-03-13T02:48:29","slug":"two-more-states-sue-mv-realty","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/12\/19\/two-more-states-sue-mv-realty\/","title":{"rendered":"Two more states sue MV Realty"},"content":{"rendered":"\n<p>Earlier this month, the attorney general\u2019s office in Florida <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/florida-attorney-general-sues-mv-realty\/\">sued<\/a> real estate brokerage <strong>MV Realty<\/strong> for what it called a \u201ccomplex and deceptive scheme&#8221; involving the company&#8217;s Homeowner Benefit Program. <\/p>\n\n\n\n<p>Now, attorneys general Josh Shapiro in Pennsylvania and Maura Healey in Massachusetts have also filed lawsuits against MV Realty and its founder, Amanda Zachman.<\/p>\n\n\n\n<p>The Homeowner Benefit Program gives homeowners\u00a0$300 to $5,000 in cash as a loan alternative, which is an integral part of the Homeowner Benefit Agreement (HBA). <\/p>\n\n\n\n<p>The Massachusetts attorney general accused MV Realty of using the program to target low-income and elderly consumers in immediate need of cash. Ads included phrases such as \u201cRemember, because it\u2019s not a loan, there is NO repayment\u201d and \u201cyou NEVER repay these funds.\u201d\u00a0<\/p>\n\n\n\n<p>\u201cMV Realty conceals in its marketing and sales processes material terms including its ability to foreclose on the home, that the company only acts as a \u201cnon-agent facilitator,\u201d and that if the heirs won\u2019t assume the agreement after a homeowner\u2019s death, MV Realty can foreclose,\u201d <a href=\"https:\/\/www.mass.gov\/news\/ag-healey-sues-florida-company-for-scamming-financially-struggling-residents-into-mortgaging-their-homes-in-exchange-for-small-cash-payments\">according to<\/a> the Massachusetts suit.<\/p>\n\n\n\n<p>\u201cA non-agent facilitator is a type of transaction broker that owes no duty of loyalty to the seller, has no obligation to seek the highest price the market will bear, and owes no duty of confidentiality to the seller,\u201d the complaint reads.<\/p>\n\n\n\n<p>The lawsuits allege that MV Realty misled and confused homeowners through this program because the contracts also required them to give the brokerage exclusive rights to sell their properties for a period of 40 years.<\/p>\n\n\n\n<p>\u201cAs presented to consumers, it entitles MV Realty to a &#8216;commission&#8217; payment of at least ten times the advance when the homes are sold,\u201d the <a href=\"https:\/\/www.mass.gov\/doc\/mv-realty-complaint\/download\">lawsuit filed<\/a> in Massachusetts reads.<\/p>\n\n\n\n<p>If a homeowner lists their property for sale during the 40-year term and fails to use MV Realty as its listing broker, or in the case of a home foreclosure or cancellation of the deal, the brokerage would demand 3% of the property\u2019s value, according to the contract.\u00a0<\/p>\n\n\n\n<p>In addition, the program also allows MV Realty to place a lien on the home, making it difficult for homeowners to access home equity through refinancing, reverse mortgages and home equity lines of credit.<\/p>\n\n\n\n<p>Pennsylvania-based real estate brokers do not typically take a mortgage lien on their clients\u2019 property before providing services, but what MV Realty is accused of doing is not disclosing these terms to consumers upfront.<\/p>\n\n\n\n<p>The Massachusetts lawsuit states the brokerage\u2019s website made no reference to a lien or mortgage.<\/p>\n\n\n\n<p>In the FAQ section of its website, MV Realty states under the question, \u201cDo you file a lien on my house?\u201d:<\/p>\n\n\n\n<p>\u201cNo, we file a memorandum. The purpose of the memorandum is to serve public notice of the homeowner\u2019s obligations under the HBP agreement.\u201d<\/p>\n\n\n\n<p>The Attorney General in Florida<a href=\"http:\/\/myfloridalegal.com\/webfiles.nsf\/WF\/CPAL-CLMSK3\/$file\/Web+Link.pdf\"> stated<\/a> that these liens are illegal under Florida law. MV Realty made more than 9,123 public record filings that might \u201ccloud\u201d homeowners\u2019 titles and Hillsborough County is one of the counties with a high number of public record filings, according to the attorney general&#8217;s office. At least 588 people in northeast Florida and southeast Georgia have signed up to the program.<\/p>\n\n\n\n<p>The Commonwealth of Pennsylvania <a href=\"https:\/\/www.attorneygeneral.gov\/wp-content\/uploads\/2022\/12\/2022-12-14-MV-Realty-Timestamped-Complaint.pdf\">believes<\/a> MV Realty\u2019s practices are in violation of the Unfair Trade Practices and Consumer Protection Law and calls for civil penalties against the brokerage.<\/p>\n\n\n\n<p>\u201cPennsylvania homeowners are falling victim to MV Realty\u2019s calculated deception in hiding the terms of the Homeowner Benefit Program,\u201d said Pennsylvania AG Shapiro. \u201cMV Realty is a scam that exploits Pennsylvanians in vulnerable financial situations, and my Office isn\u2019t buying it. My Office will protect homeowners\u2019 most important asset\u2013 the value of their real estate.\u201d<\/p>\n\n\n\n<p>The Pennsylvania lawsuit notes that 1,000 mortgages are tied to MV Realty and estimate there could be more.&nbsp;<\/p>\n\n\n\n<p>Through the court order in Pennsylvania, the suit seeks restitution for people who suffered losses, and wants the company to strike all mortgages recorded in every county, refrain from further contracts with Pennsylvania-based consumers, pay $1,000 in civil penalties for each violation of a consumer, and pay $3,000 for every violation where the consumer is 60 years or older.<\/p>\n\n\n\n<p>The lawsuit filed in Massachusetts accuses MV Realty of falsely marketing the HBA to consumers as a &#8220;loan alternative.&#8221; Based on the complaint\u2019s interpretation, it is a method of paying homeowners a median cash advance of $1,150 in exchange for the homeowners&#8217; agreement to give the brokerage rights to sell their homes for a 40-year term.<\/p>\n\n\n\n<p>\u201cThe HBA is secured by a power of sale mortgage on the homeowner&#8217;s property, which permits non-judicial foreclosure in the event of a breach,\u201d the lawsuit says. \u201cBased on the terms of the HBA and MV&#8217;s business model, MV is a financial institution pedaling a usurious financial instrument while masquerading as a real estate brokerage firm.\u201d<\/p>\n\n\n\n<p>The Massachusetts AG also alleges that the company uses deceptive marketing techniques, including mortgaging homeowners\u2019 properties, which violates Massachusetts laws.&nbsp;<\/p>\n\n\n\n<p>The AG\u2019s office filed for a temporary restraining order and preliminary injunction to ban the brokerage from offering further contracts to consumers in the state.<\/p>\n\n\n\n<p>\u201cMV Realty\u2019s business model and contract terms are unconscionable, targeting elderly and financially vulnerable homeowners who are short on cash, only to leave them with agreements they don\u2019t understand and can\u2019t get out of,\u201d said AG Healey. \u201cWe are suing to get homeowners out of these contracts, protect our residents from this scheme, and stop this predatory company from doing any more business here in Massachusetts.\u201d<\/p>\n\n\n\n<p>The lawsuit seeks a civil penalty of $5,000 for each violation, as well as costs of investigation and litigation of the violations, and reasonable attorneys&#8217; fees, plus payment to consumers in the amount of their actual costs and damages, and other \u201cequitable\u201d costs.<\/p>\n\n\n\n<p>MV Realty has sold more than 500 HBAs to Massachusetts homeowners.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>After Florida&#8217;s attorneys general&#8217;s lawsuit against MV Realty, Pennsylvania and Massachusetts AGs, also sued the brokerage and its founder.<\/p>\n","protected":false},"author":39545,"featured_media":4822,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3255],"tags":[],"coauthors":[2886],"class_list":["post-3806","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-archive"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v26.8) -
