{"id":3802,"date":"2022-12-16T18:26:08","date_gmt":"2022-12-16T18:26:08","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/12\/16\/trial-for-nar-brokerage-class-action-commission-lawsuit-is-postponed\/"},"modified":"2025-03-13T02:48:28","modified_gmt":"2025-03-13T02:48:28","slug":"trial-for-nar-brokerage-class-action-commission-lawsuit-is-postponed","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/12\/16\/trial-for-nar-brokerage-class-action-commission-lawsuit-is-postponed\/","title":{"rendered":"Trial for NAR, brokerage class action commission lawsuit is postponed"},"content":{"rendered":"\n<p>Those awaiting the verdict from a federal <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/flawed-real-estate-commission-lawsuits\/\" target=\"_blank\" rel=\"noreferrer noopener\">class action commission lawsuit<\/a> filed against the \u00a0<strong>National Association of Realtors <\/strong>(NAR) and several national brokerages will have to wait a bit longer.<\/p>\n\n\n\n<p>The trial in the Sitzer lawsuit (named after its lead plaintiff) was scheduled to begin on February 21, 2023, but at the request of real estate conglomerate <strong>Anywhere<\/strong> (referred to as <strong><a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/it-is-sort-of-a-beacon-cfo-on-anywhere-rebrand\/\" target=\"_blank\" rel=\"noreferrer noopener\">Realogy<\/a><\/strong> in all court filings), has been postponed indefinitely.<\/p>\n\n\n\n<p>Judge Stephen R. Bough of U.S. District Court in Western Missouri&nbsp;granted <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/realogy-takes-aim-at-nar-cooperative-compensation-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">Anywhere\u2019s<\/a> motion to continue on December 13. In his ruling, Bough said the court would choose a new trial date \u201cin late 2023,\u201d but an exact timeline was not provided.<\/p>\n\n\n\n<p>Unlike <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/understanding-realogys-stance-on-commissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Anywhere<\/a>, NAR is staunchly against the trial postponement.<\/p>\n\n\n\n<p>\u201cThe National Association of REALTORS\u00ae was prepared for trial, and regardless of the timing, we are confident we will prevail,\u201d Mantill Williams, NAR\u2019s vice president of communications, wrote in an emailed statement. \u201cThe U.S. model of local broker marketplaces has long been \u2013 and is still \u2013 viewed as the best value for consumers around the world. Local broker marketplaces provide sellers equal access to the largest possible pool of potential buyers and create the greatest number of housing options for buyers in one place without hidden or extra costs. Listing brokers making offers of compensation to buyer brokers also gives first-time, low\/middle-income and all homebuyers a better shot at affording a home and professional representation.\u201d<\/p>\n\n\n\n<p>The lawsuit, which was originally filed in 2019 and won class-action status in April, alleges that some NAR rules, including one that <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/average-annual-real-estate-commission-rate-rises-slightly-in-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">requires listing brokers to offer buyer brokers a commission<\/a> in order to list a property in a realtor-affiliated MLS, violate the Sherman Antitrust Act by inflating seller costs.<\/p>\n\n\n\n<p>Through the class certification, hundreds of thousands of home sellers in four MLS markets in Missouri can ask the defendants, which include <strong>Keller Williams<\/strong>, <strong>RE\/MAX<\/strong>, <strong>HomeServices of America<\/strong> and its subsidiaries <strong>BHH Affiliates<\/strong> and <strong>HSF Affiliates<\/strong>, as well as Realogy and NAR, to be reimbursed for the $1.3 billion in commissions they paid to buyers\u2019 agents in the past eight years. However, potential treble damages could put the total damages in the case at around $4 billion.<\/p>\n\n\n\n<p>Earlier this year the defendants filed a <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/in-real-estate-commission-row-judge-denies-arbitration-motion\/\" target=\"_blank\" rel=\"noreferrer noopener\">motion to compel the plaintiffs into arbitration<\/a> rather than have the court decide the case, but this motion was denied by Bough in July. In response, HomeServices and its subsidiaries appealed the decision to the U.S. Court of Appeals for the Eighth Circuit. <\/p>\n\n\n\n<p>While the appeal is pending, Bough granted a stay on any claims raised by unnamed class members who executed a listing agreement containing a binding arbitration clause with a subsidiary of HomeServices.<\/p>\n\n\n\n<p>Due to his granting of that stay, Bough sided with Realogy and agreed to postpone the trial date until after the HomeServices\u2019 appeal is decided.<\/p>\n\n\n\n<p>\u201cDespite the plaintiffs\u2019 arguments to the contrary, this Court believes that all parties need to be present throughout the case if there is to be joint and several liability as argued by plaintiff and that the Eighth Circuit currently has jurisdiction over the stayed claims,\u201d Bough wrote in his decision.<\/p>\n\n\n\n<p>\u201cJoint and several liability\u201d means that all of the defendants would be held independently responsible for 100% of the damages from the alleged conspiracy if that conspiracy is proven.<\/p>\n\n\n\n<p>RE\/MAX and Keller Williams both responded that they typically do not comment on ongoing litigation, while Anywhere and HomeServices of America had not returned a request for comment by the time of publication.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The lawsuit alleges that some NAR rules violate the
