An agent would never list a property without a contract, right? So, why do so few agents require a buyer representation agreement?&nbsp;It&#8217;s not standard practice because it can be a difficult conversation to have with buyers.<\/p>\n\n\n\n<p>In a November session at the <strong>National Association of Realtors<\/strong> NXT Conference in Orlando, Adorna Carroll, president of <strong>Dynamic Directions<\/strong>, who trains real estate agents on buyer\/seller representation, offered what she says is one way to get ahead of any decisions on <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/real-estate-agent-commissions-continue-to-drop\/\" target=\"_blank\" rel=\"noreferrer noopener\">buyer commissions<\/a> coming down from the multiple <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/federal-court-dismisses-commission-sharing-case-against-nar\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a> currently moving through the court. <\/p>\n\n\n\n<p>\u201cYour guess is as good as mine about what\u2019s going to happen,\u201d she said. \u201cAgents must move from a subagency or transaction brokerage mindset to a representation mindset because that\u2019s going to be the value proposition.\u201d<\/p>\n\n\n\n<p>For buyer\u2019s agents getting a signed buyer agreement requires a careful conversation about the amount of time you will be spending with your buyers to find them their dream home. Yet, rather than propose a signed buyer agreement, agents often do this work ministerially, keeping their fingers crossed that the buyers won\u2019t act without them or with a different agent.<\/p>\n\n\n\n<p>The next time a homebuyer approaches you for assistance in finding their dream home, have them sign on the dotted line. \u201cI recommend you tell them, \u2018There are certain things that I need to cover here so we can mitigate your risk and we can manage mine,\u2019\u201d she said.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-putting-together-a-process-for-buyer-representation\">Putting together a process for buyer representation<\/h3>\n\n\n\n<p>According to Carroll, there are several classes that you can take to guide you in how to approach buyers when requesting they sign an exclusive buyer agreement. Some that she recommends are: <a href=\"https:\/\/www.nar.realtor\/education\/designations-and-certifications\/accredited-buyers-representative-abr\" target=\"_blank\" rel=\"noreferrer noopener\">Accredited Buyers Representative course<\/a> (ABR), the Seller Rep Specialist course (SRS) and the <a href=\"https:\/\/www.nar.realtor\/education\/designations-and-certifications\/real-estate-negotiation-expert-rene\" target=\"_blank\" rel=\"noreferrer noopener\">Real Estate Negotiation Expert designation<\/a> (RENE). Enrolling in these courses and earning these certifications will elevate an agent\u2019s skill set and reassure buyers that they are working with a seasoned professional.&nbsp;<\/p>\n\n\n\n<p>But once you\u2019ve acquired the skill set to <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/7-tips-to-engage-your-real-estate-sphere-of-influence\/?__hstc=44321979.f40075c7cd00f7c1f90f44bba0a8c1bb.1654526048542.1669836525409.1669906704410.332&amp;__hssc=44321979.22529.1669906704410&amp;__hsfp=69714730\">attract buyers<\/a>, what do you include in a buyer\u2019s contract? How do you write one? And most importantly, how do you get buyers to sign?&nbsp;<\/p>\n\n\n\n<p>According to Carroll, there are a few key points that every buyer\u2019s contract should cover:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>What the agent can do by law<\/li><li>What the agent can\u2019t do by law<\/li><li>The agent\u2019s business routine<\/li><li>A start and end date<\/li><li>Payment guidelines<\/li><\/ul>\n\n\n\n<p>For best results and to create a non-voidable contract, said Carroll, it is not recommended to include price ranges or property types in the buyer\u2019s contract. The buyer could change their mind on any of these finer details.&nbsp;<\/p>\n\n\n\n<p>Some buyer\u2019s contracts include termination fees, but not all do. Whether or not you decide to include a termination fee will be largely based on personal experience. Some agents require termination fees for any expenses they forwarded on behalf of the buyer in the search process.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Have an attorney review the agreement<\/h3>\n\n\n\n<p>After you create a buyer representation agreement, enlist the help of an attorney to review the document. Carroll says to go into any meeting with an attorney with one question, \u201cCan you defend me based on this contract?\u201d If they don\u2019t say yes, she notes, it&#8217;s back to the drawing table. You need a document that binds you to these buyers and guarantees your compensation.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">No exceptions<\/h3>\n\n\n\n<p>Using a buyer representation agreement is important whether you are working with buyers you know, like family, friends or colleagues, or complete strangers.&nbsp;<\/p>\n\n\n\n<p>It may be easier to get known clients to sign on the dotted line, but for some reason, agents are least likely to ask them to do so. In reality, these known clients probably make up a large percentage of your client base. The decision to contractually represent these buyers can revolutionize business.&nbsp;<\/p>\n\n\n\n<p>Asking <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/5-marketing-and-lead-generation-ideas-for-thrifty-new-agents\/\">unknown, or new, clients<\/a> to sign a buyer\u2019s contract has its challenges as well. They may not yet feel comfortable signing with an agent they\u2019re unfamiliar with, and that is okay. You don\u2019t want the business of a buyer who will be difficult to work with. However, if an unknown client does sign, then you have a set of parameters on which you can build a relationship with them. Allow them to ask questions about the process and spend time with you in your office so they feel assured in their decision to sign with you.&nbsp;<\/p>\n\n\n\n<p>Your time is valuable, and a signed buyer representation agreement ensures that your value is recognized.&nbsp;<\/p>\n\n\n\n<p><em>This information is meant as a guideline and not legal advice.
