{"id":3548,"date":"2022-10-04T17:46:17","date_gmt":"2022-10-04T17:46:17","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/10\/04\/judge-forces-anywhere-to-hand-over-documents\/"},"modified":"2025-03-13T02:47:10","modified_gmt":"2025-03-13T02:47:10","slug":"judge-forces-anywhere-to-hand-over-documents","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/10\/04\/judge-forces-anywhere-to-hand-over-documents\/","title":{"rendered":"Judge forces Anywhere to hand over documents"},"content":{"rendered":"\n<p>A U.S. District Court judge in Boston on Monday partially granted a motion to compel real estate conglomerate <strong>Anywhere<\/strong> (<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/it-is-sort-of-a-beacon-cfo-on-anywhere-rebrand\/\" target=\"_blank\" rel=\"noreferrer noopener\">formerly known as <strong>Realogy<\/strong><\/a> and referred to as such in the suit and legal proceedings regarding the case) to produce all documents relating to its implementation of what the plaintiffs refer to as the \u201c<a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/average-annual-real-estate-commission-rate-rises-slightly-in-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">Buyer Broker Commission Rule<\/a>,\u201d across the country.<\/p>\n\n\n\n<p>The class action lawsuit known as Nosalek V. <strong>Mls Property Information Network<\/strong>, Inc. Et Al, as originally filed in December 2020, and alleges that large, broker-owned multiple listing service MLS PIN is not directly required to abide by <strong>National Association of Realtors<\/strong> rules but has nonetheless adopted a rule similar to a <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/nar-petitions-supreme-court-on-pocket-listing-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">NAR<\/a> rule that requires listing brokers to offer a blanket, unilateral offer of compensation to buyer brokers in order to submit a listing to MLS PIN.<\/p>\n\n\n\n<p>MLS PIN has approximately 46,000 agent and broker subscribers throughout Massachusetts, Rhode Island and New Hampshire.<\/p>\n\n\n\n<p>According to the plaintiff\u2019s filing, other defendants, including <strong>RE\/MAX<\/strong>, <strong>Keller Williams<\/strong> and <strong>HomeServices of America<\/strong>, had agreed to produce documents on their implementation of the rule nationwide, so long as those documents aren\u2019t tied to implementation of the rule in specific geographic regions other than that of MLS PIN. Anywhere, however, refused to produce documents regarding the implementation of the rule outside of MLS PIN\u2019s service area. In response, the plaintiffs filed a motion to compel in August.<\/p>\n\n\n\n<p>Ultimately a judge granted the plaintiffs\u2019 motion \u201cto the extent it seeks discovery from Anywhere on the same terms to which the other broker defendants have agreed\u201d but denied it \u201cto the extent it seeks discovery outside the scope of the agreement with the other broker defendants.\u201d<\/p>\n\n\n\n<p>During a livestreamed <a href=\"https:\/\/www.inman.com\/2022\/09\/26\/judge-baffled-why-anywhere-wont-give-up-nar-commission-rule-docs\/\" target=\"_blank\" rel=\"noreferrer noopener\">late September hearing<\/a> regarding the plaintiffs\u2019 motion, Magistrate Judge M. Page Kelley, told Anywhere\u2019s counsel at the hearing, \u201cI am just a little baffled about why you wouldn\u2019t join in the compromise that everyone else has. It just seemed like you\u2019re kind of an outlier on that.\u201d<\/p>\n\n\n\n<p>In response to Anywhere\u2019s arguments that \u201cnationwide discovery is not relevant for a three-state claim,\u201d Kelley wrote in the order: \u201cSuch discovery is relevant to plaintiffs\u2019 claim, first, because Section 5 and the NAR Rule are substantively identical and Section 5 almost certainly was modeled on the NAR Rule. Second, plaintiffs allege that Anywhere was involved in, if not the implementation, then at least the perpetuation of both rules.\u201d<\/p>\n\n\n\n<p>At the time of publication, counsel for the plaintiffs had not returned a request for comment.
