{"id":3495,"date":"2022-09-14T19:26:17","date_gmt":"2022-09-14T19:26:17","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/09\/14\/zillow-named-in-digital-privacy-lawsuit\/"},"modified":"2025-03-13T02:46:49","modified_gmt":"2025-03-13T02:46:49","slug":"zillow-named-in-digital-privacy-lawsuit","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/09\/14\/zillow-named-in-digital-privacy-lawsuit\/","title":{"rendered":"Zillow named in digital privacy lawsuit"},"content":{"rendered":"\n<p>Although things remain quiet on the <a href=\"https:\/\/preprod.housingwire.com\/articles\/judge-lets-nar-zillow-lawsuit-proceed\/?__hstc=43385018.c1200c13b5ffe2d787c2a413a4fe14b9.1635527061029.1663097839430.1663169875657.628&amp;__hssc=43385018.4.1663169875657&amp;__hsfp=428098088\" target=\"_blank\" rel=\"noreferrer noopener\">anti-trust suit<\/a> front, <strong>Zillow<\/strong>\u2019s <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/zillow-dodges-vermont-fsbo-antitrust-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal team<\/a> isn&#8217;t getting a break. On Monday, the home listing site was named as a defendant in a class action lawsuit filed in a U.S. District Court in Seattle.<\/p>\n\n\n\n<p>Plaintiffs Natalie Perkins and Kenneth Hasson alleged that <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/zillow-pegs-five-pillars-as-key-to-future-growth\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zillow<\/a> used \u201csession replay\u201d software manufactured by <strong>Microsoft<\/strong> to clandestinely track user activity on its website, essentially wiretapping the electronic communications of visitors to Zillow\u2019s website, which they claim violates the Washington Wiretapping Statute and constitutes an invasion of the privacy rights of website visitors.<\/p>\n\n\n\n<p>Microsoft was also named as a defendant in the lawsuit.<\/p>\n\n\n\n<p>\u201cZillow procures third-party vendors, such as Microsoft Corporation, to embed snippets of JavaScript computer code (\u201cSession Replay Code\u201d) on Zillow\u2019s website, which then deploys on each website visitor\u2019s internet browser for the purpose intercepting and recording the website visitor\u2019s electronic communications with the Zillow website, including their mouse movements, clicks, keystrokes (such as text being entered into an information field or text box), URLs of web pages visited, and\/or other electronic communications in real-time (\u201cWebsite Communications\u201d),\u201d the suit stated. \u201cThese third-party vendors (collectively, \u201cSession Replay Providers\u201d) create and deploy the Session Replay Code at Zillow\u2019s request.\u201d<\/p>\n\n\n\n<p>According to the lawsuit, Zillow can then use the website communications to recreate website visitors\u2019 entire visit to the Zillow website, enabling Zillow to virtually \u201clook over the shoulder\u201d of each site visitor \u201cunbeknownst to the millions of individuals perusing Zillow\u2019s real estate listings.\u201d<\/p>\n\n\n\n<p>The lawsuit defines the class represented in the suit as: \u201cAll natural persons in the United States and its territories whose Website Communications were captured through the use of Session Replay Code embedded in Zillow\u2019s website.\u201d<\/p>\n\n\n\n<p>The class has yet to be certified.<\/p>\n\n\n\n<p>This is not the only digital privacy lawsuit the listings giant is currently facing. The firm is dealing with a similar lawsuit in <a href=\"https:\/\/news.bloomberglaw.com\/litigation\/zillow-lowes-expedia-sued-over-use-of-browser-tracking-tech\" target=\"_blank\" rel=\"noreferrer noopener\">Pennsylvania<\/a> that claims that the \u201csession replay\u201d technology used by the firm violates the Pennsylvania Wiretapping and Electronic Surveillance Control Act.<\/p>\n\n\n\n<p>\u201cZillow takes the privacy and security of users\u2019 information very seriously,\u201d a Zillow spokesperson wrote in an email. \u201cWe are transparent with our users through our privacy policy, which explains to users the types of information we collect as they use our apps and websites.
