{"id":3324,"date":"2022-07-21T20:58:52","date_gmt":"2022-07-21T20:58:52","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/07\/21\/are-fair-housing-laws-falling-by-the-wayside-in-todays-market\/"},"modified":"2025-03-13T02:44:38","modified_gmt":"2025-03-13T02:44:38","slug":"are-fair-housing-laws-falling-by-the-wayside-in-todays-market","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/07\/21\/are-fair-housing-laws-falling-by-the-wayside-in-todays-market\/","title":{"rendered":"Are fair housing laws falling by the wayside in today&#8217;s market?"},"content":{"rendered":"\n<p><em>\u201cWithout a love letter, we wouldn\u2019t have been able to find a home as newlyweds because we both are independent contractors.\u201d<\/em><\/p>\n\n\n\n<p><em>\u201cThey were able to win the bidding war because they wrote a letter to the seller sharing how much buying this home would mean to their three-generational, Latino family.\u201d<\/em><\/p>\n\n\n\n<p>Those are two direct quotes from a recent <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/opinion-54-years-after-the-fair-housing-act-challenges-remain\/\" target=\"_blank\" rel=\"noreferrer noopener\">fair housing<\/a> course I taught.<\/p>\n\n\n\n<p>In one case, it was the real estate professional that shared how her protected class status was likely the very thing that helped her purchase a home.<\/p>\n\n\n\n<p>In the other instance, the real estate professional shared how her customers kept getting offer after offer rejected until they shared their protected classes in a warm and fuzzy letter with adorable family photos with their pup.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-you-may-be-in-similar-circumstances\">You may be in similar circumstances.<\/h4>\n\n\n\n<p>Either you or your customers are attempting to buy homes in a hot housing market. It may feel like:<\/p>\n\n\n\n<p><em>\u00a0\u201cAll rules go out the window.\u201d<\/em><\/p>\n\n\n\n<p><em>\u201cDesperate times call for desperate measures\u201d<\/em>\u00a0<\/p>\n\n\n\n<p>The end goal of homeownership is justifiable \u201cby any means necessary.\u201d<\/p>\n\n\n\n<p>In essence, some housing markets can feel like the wild, wild west, where anything goes.<\/p>\n\n\n\n<p>Yet, there are several problems here. Yes, it breaks <a href=\"https:\/\/www.hud.gov\/program_offices\/fair_housing_equal_opp\/fair_housing_act_overview\" target=\"_blank\" rel=\"noreferrer noopener\">Fair Housing law<\/a> to be chosen (or denied) based on a protected class, which includes federally:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Disability\u00a0<\/li><li>Familial (age)\u00a0<\/li><li>Religion<\/li><li>Race\u00a0<\/li><li>Color\u00a0<\/li><li>Sex (gender\/orientation)\u00a0<\/li><li>National origin<\/li><\/ul>\n\n\n\n<p>But we should be concerned with the bigger picture and its implications:&nbsp;<\/p>\n\n\n\n<p><strong>In invoking various protected classes, we as licensed, trained real estate professionals \u2013 who have a fiduciary duty to our clients, the public and the laws of the land \u2013 are willing to discriminate, at worst, (or, at least, to look the other way) to close a deal.<\/strong>&nbsp;<\/p>\n\n\n\n<p>It is one thing to violate a law unintentionally. It is another to do it knowingly. Make no mistake about it, we real estate professionals are charged with knowing the law.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/preprod.realtrends.com\/blog\/wp-content\/uploads\/sites\/9\/2025\/03\/tNQEO4izkTtbm-HTHgaLWOBxZPb2Zqyk3lNGAURbImF8GMjTeFQa7zSffQMDxf0InciNaMCymHSiMlIs9U2ormz8O4WTyr8s33Xd03Yee0kP9mYTZpuFzKqv18WQeC9aaKHemafsjp05yCv0jmInhhk.png\" alt=\"\" width=\"456\" height=\"341\"\/><\/figure><\/div>\n\n\n\n<p>From our Family Feud responses (see <a href=\"https:\/\/preprod.realtrends.com\/blog\/tag\/dr-lee-davenport\/\">part 1 of this series<\/a>), it is problematic when we do not help our buyer clients navigate sellers\u2019 unconscious (or conscious) biases, particularly when they can impede fair housing for anyone, whether for our clients or the \u201ccompetition.\u201d\u00a0<\/p>\n\n\n\n<p>Did you catch that? Being committed to fair housing is not simply when it is in the best interest of our client.<\/p>\n\n\n\n<p>Sure, we can pull on a home seller\u2019s heart strings by sharing a sob story that illegally focuses on protected classes. But that unethical and illegal act (even if you never get caught), means we are no better than the sleazy memes that people post about real estate professionals.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/preprod.realtrends.com\/blog\/wp-content\/uploads\/sites\/9\/2025\/03\/nKu1HbHq7LCfNlIaVBZURoj1Q_9GY3jQ_gnNmsl880jUgwSZfBkeodfjqHAGBAiW97TIAjkk0HBPsKf0Zfjv96o0SIoigv9dy_hStTIJPpbnRoJL18pwBBuxKvWieVI5BiYf7P3nP4YCDzHr-NexAOs.png\" alt=\"\" width=\"383\" height=\"473\"\/><\/figure><\/div>\n\n\n\n<p>I want to challenge all real estate professionals to do some genuine soul-searching here:\u00a0<\/p>\n\n\n\n<p><strong>Do we believe that <\/strong><strong><em>all<\/em><\/strong><strong> people have the right to choose where they want to live in the U. S. free from discrimination\u2063\u2063?&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>Or, should it only be when they are not competing with us or our clients?<\/strong><\/p>\n\n\n\n<p>For this reason (that protected classes may be used to illegally one-up others), I am not a fan of \u2018love letters.\u2019.\u00a0<\/p>\n\n\n\n<style>.embed-container { position: relative; padding-bottom: 56.25%; height: 0; overflow: hidden; max-width: 100%; } .embed-container iframe, .embed-container object, .embed-container embed { position: absolute; top: 0; left: 0; width: 100%; height: 100%; }<\/style><div class='embed-container'><iframe src='https:\/\/www.youtube.com\/embed\/\/ENktsClbg6g' frameborder='0' allowfullscreen><\/iframe><\/div>\n\n\n\n<p>But \u2018love letters\u2019 are not illegal (anymore \u2013 <a href=\"https:\/\/preprod.realtrends.com\/blog\/articles\/in-oregon-real-estate-love-letters-live-on\/\" target=\"_blank\" rel=\"noreferrer noopener\">Oregon tried<\/a>) and can speak to your client\u2019s ability to close without any surprises (that\u2019s truly what most sellers want, right?) by listing:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The agent\/broker\u2019s:<ol><li>designations\/education<\/li><li>how many similar deals closed\u00a0<\/li><li>average days to close speed and\u00a0<\/li><li>client testimonies\u00a0<br>Note: if you are a new real estate pro, share data from your team\/firm for these information points as you may not have enough personal data.<\/li><\/ol><\/li><li>The same as number one for the lender, assistance programs, and other partners in the process (your team.)<\/li><li>Other unique resources that your real estate team offers that helps deals to close headache-free, just stay away from mentioning protected classes or anything that alludes to a protected class, like sharing a family photo. (Bonus: Include an explainer on why such information is UN-fair housing)<\/li><\/ol>\n\n\n\n<p>It is not discussed enough but fair housing is not automatic, despite laws. We understand that easily when it comes to other laws. For instance, if you have every seen <strong>Dateline<\/strong>, you know that despite murder and kidnapping being illegal, those crimes still happen, and sometimes the violators never get caught or face a penalty. <\/p>\n\n\n\n<p>Unfortunately, fair housing laws are no different \u2013 they can be and sometimes are violated without any restitution. Thus, real estate professionals must be fair housing advocates 24\/7 (what I call <a href=\"https:\/\/www.learnwithlee.realtor\/2022\/07\/how-to-be-fair-housing-decoder-real.html\">Fair Housing DECODERS<\/a>) for <strong><em>everyone<\/em><\/strong> in our community, whether clients or not, in hot housing markets or not.<\/p>\n\n\n\n<p><strong><em><a href=\"https:\/\/www.learnwithlee.realtor\/\" target=\"_blank\" rel=\"noreferrer noopener\">Dr. Lee Davenport<\/a>\u00a0is a real estate coach and consultant.
