{"id":3078,"date":"2022-05-02T19:35:02","date_gmt":"2022-05-02T19:35:02","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/05\/02\/court-dismisses-nars-countersuit-against-rex\/"},"modified":"2025-03-13T02:41:39","modified_gmt":"2025-03-13T02:41:39","slug":"court-dismisses-nars-countersuit-against-rex","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/05\/02\/court-dismisses-nars-countersuit-against-rex\/","title":{"rendered":"Court dismisses NAR\u2019s countersuit against REX"},"content":{"rendered":"\n<p>A federal court has dismissed for now the <strong>National Association of Realtor\u2019s<\/strong> false and misleading advertising claims against discount brokerage <strong>Real Estate Exchange, Inc<\/strong>. (REX), according to a court ruling issued April 22. <\/p>\n\n\n\n<p>Judge Thomas S. Zilly&#8217;s ruling, which is part of an ongoing litigation saga between NAR, REX and Zillow in the U.S. District Court in Seattle, does give NAR permission to amend its lawsuit.<\/p>\n\n\n\n<p>Zilly&#8217;s opinion is the cousin of a lawsuit Austin, Texas-based brokerage REX filed against Zillow (certainly, no relation to Zilly) and NAR, accusing the listings site and trade group of conspiring to marginalize listings by non-NAR agents on the Zillow website. That blockbuster case remains in litigation, as the judge <a href=\"https:\/\/preprod.housingwire.com\/articles\/judge-lets-nar-zillow-lawsuit-proceed\/\">shot down<\/a> attempts to dismiss it. <\/p>\n\n\n\n<p>The courtroom setback comes amid a veritable legal storm drenching NAR. Last week, a judge <a href=\"https:\/\/preprod.realtrends.com\/blog\/judges-ruling-its-heartland-homeowners-v-nar\/\">certified a class<\/a> of hundreds of thousands of consumers in Missouri federal court in a lawsuit over NAR&#8217;s guidance on real estate commissions. Also, a federal appeals court <a href=\"https:\/\/preprod.realtrends.com\/blog\/court-revives-challenge-to-pocket-listings-ban\/\">revived a lawsuit<\/a> challenging the legality of NAR&#8217;s ban on &#8220;pocket listings.&#8221; <\/p>\n\n\n\n<p>In the ruling, Zilly found that NAR failed to allege facts to show how its reputation was specifically and concretely harmed by REX\u2019s allegedly false statements.<\/p>\n\n\n\n<p>\u201cNAR does not allege that any consumers or brokers have withheld trade from NAR as a result of the advertisements,\u201d Zilly wrote. \u201cNAR has not \u2026 alleged facts explaining how REX\u2019s purportedly false advertisements have frustrated its mission or caused it to divert its resources. Nor has NAR alleged sufficient facts to explain how REX\u2019s advertisements to consumers harm NAR\u2019s reputation and goodwill among its own members, who NAR does not claim were misled.\u201d<\/p>\n\n\n\n<p>While the granted REX\u2019s motion, Zilly did not agree with REX\u2019s claims the case should be junked because REX\u2019s statements are protected First Amendment speech and that the counterclaim \u201cinfringes on REX\u2019s First Amendment right to express opinions on legal and policy matters.\u201d<\/p>\n\n\n\n<p>\u201cAlthough REX contends that its statements are constitutionally protected opinions about the legality of NAR\u2019s business model, NAR has alleged that posts on REX\u2019s website are false advertisements designed to promote REX\u2019s business and influence consumers to use REX\u2019s services,\u201d Zilly wrote in the ruling. \u201cNAR has identified specific statements that contain verifiable characteristics of REX\u2019s business.&#8221;<\/p>\n\n\n\n<p>&#8220;That REX made certain statements to the media, and later posted those statements on its website,&#8221; the judge continued, &#8220;Does not change the result at this stage of litigation. Indeed, re-publication and dissemination of statements made to the media can constitute commercial speech. NAR has plausibly alleged that the statements on REX\u2019s website are false statements made in commercial advertising.\u201d<\/p>\n\n\n\n<p>REX filed an <a href=\"https:\/\/theamericangenius.com\/housing\/wp-content\/uploads\/sites\/2\/2021\/03\/1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">anti-trust lawsuit against NAR and Zillow<\/a> in March of 2021. In January of 2022, <a href=\"https:\/\/preprod.realtrends.com\/blog\/nar-fires-back-in-countersuit-against-discount-brokerage\/\" target=\"_blank\" rel=\"noreferrer noopener\">NAR filed a countersuit<\/a> alleging that&nbsp;REX makes false and misleading claims to deceive consumers, \u201cdiscouraging them from obtaining the pro-consumer, pro-competitive benefits provided by NAR members and independent, local multiple listing services marketplaces.\u201d NAR sought an injunction preventing REX from continuing its false and misleading practices, the monetary damages determined at the trial and the reimbursement of costs and attorneys\u2019 fees<\/p>\n\n\n\n<p>Three weeks later, in late February, REX filed a <a href=\"https:\/\/preprod.realtrends.com\/blog\/the-legal-battle-between-rex-homes-and-nar-heats-up%ef%bf%bc\/\" target=\"_blank\" rel=\"noreferrer noopener\">motion to dismiss<\/a>, challenging the legality of the claims made by NAR in the countersuit.<\/p>\n\n\n\n<p>NAR spokesperson Mantill Williams stated that NAR was disappointed in the court\u2019s decision.<\/p>\n\n\n\n<p>\u201cIt is important to note that the Court did not address NAR\u2019s allegations that REX made false and misleading statements comparing REX\u2019s services to those&nbsp;provided by brokers who are also&#8221; NAR member agents, Williams emailed.&nbsp;\u201cNAR puts consumers first&nbsp;and will defend against any effort to&nbsp;deprive them of the pro-consumer, pro-competitive benefits provided by independent, local broker marketplaces.&nbsp;We will continue our efforts to educate consumers on how local broker marketplaces&nbsp;ensure equity and transparency, and are proven to lower transaction costs for consumers.\u201d<\/p>\n\n\n\n<p>NAR would not share if it plans to file an amended counter claim.  <\/p>\n\n\n\n<p>*For its part, REX said it is &#8220;really encouraged&#8221; by the decision and are viewing it as a win. <\/p>\n\n\n\n<p>&#8220;The writing is on the wall,&#8221; Michael Toth, a spokesperson for REX said. &#8220;I think you seeing these decisions a real sense that the industry it not helping consumers by standing in the way on competition.
