{"id":3065,"date":"2022-04-27T19:16:19","date_gmt":"2022-04-27T19:16:19","guid":{"rendered":"https:\/\/preprod.realtrends.com\/blog\/2022\/04\/27\/court-revives-challenge-to-pocket-listings-ban\/"},"modified":"2025-03-13T02:41:32","modified_gmt":"2025-03-13T02:41:32","slug":"court-revives-challenge-to-pocket-listings-ban","status":"publish","type":"post","link":"https:\/\/preprod.realtrends.com\/blog\/2022\/04\/27\/court-revives-challenge-to-pocket-listings-ban\/","title":{"rendered":"Court revives challenge to pocket listings ban"},"content":{"rendered":"\n<p>The fight to undo the <strong>National Association of Realtors\u2019<\/strong> pocket listings ban is back after a federal appeals court\u2019s forceful ruling Tuesday.<\/p>\n\n\n\n<p>A three-judge <strong>U.S. 9<sup>th<\/sup> Circuit Court of Appeals<\/strong> panel reversed a lower court judge\u2019s dismissal of an antitrust lawsuit <strong>PLS.com<\/strong> \u2013 an erstwhile acronym for pocket listings service \u2013 filed against the NAR policy, officially titled Clear Cooperation.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/preprod.housingwire.com\/articles\/the-problem-with-banning-pocket-listings\/#:~:text=%E2%80%9CThe%20ban%20on%20pocket%20listings,have%20access%20to%20these%20homes.%E2%80%9D\" target=\"_blank\" rel=\"noreferrer noopener\">policy states<\/a> that real estate agents who are NAR members must publicize their listing in their designated Multiple Listings Service, or face penalties handed out by said MLS. The majority of the 600 or so MLS\u2019s nationally are owned by a local NAR affiliate.<\/p>\n\n\n\n<p>The three-judge panel did not rule on the merits of the case. But it did say PLS.com had a credible legal argument that this NAR-MLS arrangement is a harmful monopoly.<\/p>\n\n\n\n<p>\u201cThe Clear Cooperation Policy, as PLS characterizes it, shares all the hallmarks of a group boycott,\u201d wrote appellate court judge Milan Smith in the opinion. \u201cPLS\u2019s competitors coerced its suppliers (seller\u2019s agents) not to supply PLS with listings (or to do so only on highly unfavorable terms), and they did so for the express purpose of preventing PLS, a new entrant to the market after decades of little to no competition, from competing with the MLSs.\u201d<\/p>\n\n\n\n<p>The NAR responded to the ruling with a statement reading in part, &#8220;We are disappointed in this decision. The Clear Cooperation Policy advances equal opportunity in housing by ensuring listings are widely available and accessible to all.&#8221; <\/p>\n\n\n\n<p>&#8220;We look forward to the next stage of this case,&#8221; the Realtor&#8217;s group added, &#8220;in which we will show the Clear Cooperation Policy is pro-competitive and pro-consumer and consistent with all laws and regulations.&#8221; <\/p>\n\n\n\n<p>The panel\u2019s opinion sends the case back to Los Angeles federal court. Previously, federal court judge John Holcombe <a href=\"https:\/\/preprod.housingwire.com\/articles\/policing-the-pocket-listings-ban\/\" target=\"_blank\" rel=\"noreferrer noopener\">had ruled that the PLS.com<\/a> claims were baseless because it did not show the pocket listings ban ultimately harmed homesellers, or homebuyers. &nbsp;<\/p>\n\n\n\n<p>But the 9<sup>th<\/sup> Circuit panel argued, \u201cBusinesses that use a product or service as an input to provide another product or service can be consumers for antitrust purposes.\u201d<\/p>\n\n\n\n<p>The panel, in fact, seemed a bit miffed at the lower court\u2019s conclusion. \u201cThe legal basis for the district court\u2019s conclusion is not clear,\u201d Smith wrote.<\/p>\n\n\n\n<p>This particular business in question, PLS.com, was formed by a quartet of agents at The Agency, a Beverly Hills-based real estate brokerage that often represents public figures and people of extraordinary wealth.<\/p>\n\n\n\n<p>The agents, who include Agency founder Mauricio Umansky, gave PLS.com a type of snob appeal, arguing it was high-end listings not seen elsewhere, but also asserting that their service protected the privacy of clients in a way MLS\u2019s cannot. Consumer-facing websites including <strong>Zillow<\/strong>, <strong>Realtor.com<\/strong>, and <strong>Redfin<\/strong> are almost entirely straight aggregators of MLS data.<\/p>\n\n\n\n<p>PLS\u2019s current make-up as a going business is unclear.
